Quality Requirement
International legal provision establishing the requirements for the quality and quantity of goods delivered under a sales contract. It dictates that the seller must provide products that are fit for the ordinary purpose of such items or for the specific purpose the buyer communicated. When a printer orders paper for a high speed offset press, cisg article 35 binds the supplier to provide material that can withstand the physical stresses of that specific machinery.
Material Standard
Sellers must ensure that the paper board matches any samples or models previously provided to the buyer during the negotiation phase. If the delivered stock lacks the brightness or opacity of the sample, the buyer may have grounds for a claim under cisg article 35. This obligation extends to the packaging of the goods, which must be sufficient to protect the rolls or sheets from humidity and mechanical damage during transit.
Timely Inspection
Buyers lose the right to rely on a lack of conformity if they do not notify the seller within a reasonable time after the defect is discovered. This rule prevents late stage claims for moisture damage or surface defects that could have been identified upon delivery. Verification of cisg article 35 requires immediate laboratory testing.
